These terms govern your use of the website at zhakura.studio (the “Site”), operated by zhakura studio GmbH, Zürich, Switzerland (“zhakura studio”, “we”, “us”). By accessing or using the Site, you agree to these terms. If you do not agree, please do not use the Site.

2. Use of the Site
The Site is a portfolio and information website. You may view and use it for your own personal, non-commercial information. You agree not to:
- use the Site unlawfully or in breach of these terms;
- attempt to gain unauthorised access to the Site, its servers, or connected systems;
- introduce malware, or interfere with the Site’s operation, security, or availability;
- scrape, harvest, or systematically extract content except as permitted by law;
- use the Site in a way that infringes the rights of, or restricts the use by, others.
3. Intellectual property
All content on the Site — including text, design, code, logos, the “zhakura” name and mark, photography, and case-study material — is owned by zhakura studio or its licensors and is protected by copyright and other intellectual-property rights. Client work and images shown may include third-party rights and are displayed with permission. You may not copy, reproduce, republish, distribute, or create derivative works from any content without our prior written consent, except for brief quotation with attribution as permitted by law.
4. Third-party links
The Site may link to third-party websites (for example social profiles). We do not control and are not responsible for their content, practices, or availability. Following such links is at your own risk and subject to those third parties’ own terms.
5. No warranty
The Site and its content are provided “as is” and “as available” for general information only. To the extent permitted by law, we make no warranties, express or implied, as to the Site’s accuracy, completeness, fitness for a particular purpose, or uninterrupted availability. Nothing on the Site constitutes professional, legal, or commercial advice, nor a binding offer.
6. Limitation of liability
To the fullest extent permitted by Swiss law, zhakura studio shall not be liable for any damage arising from access to, use of, or inability to use the Site, including indirect or consequential damage and loss of data. This limitation does not exclude or limit liability where it may not lawfully be excluded — in particular for unlawful intent or gross negligence, or for personal injury (Art. 100 of the Swiss Code of Obligations).
7. Client engagements are separate
These terms cover use of the Site only. Any studio, design, development, or consulting work we carry out for a client is governed by a separate written agreement (proposal, statement of work, or contract) between us and that client, which prevails over these terms for that work. The Site itself does not constitute an offer to enter into such an agreement.
8. Data protection
Our handling of personal data is described in our Privacy Policy, which forms part of these terms.
9. Changes
We may update these terms from time to time. The version published on this page at the time you use the Site applies. Continued use after changes take effect constitutes acceptance.
10. Governing law and jurisdiction
These terms and any dispute arising from or in connection with the Site are governed by substantive Swiss law, excluding its conflict-of-law rules and any international treaties such as the CISG. The exclusive place of jurisdiction is Zürich, Switzerland, subject to any mandatory statutory forum (for example, at a consumer’s domicile).
11. Severability
If any provision of these terms is held invalid or unenforceable, the remaining provisions remain in full effect, and the invalid provision shall be replaced by a valid one that comes closest to its intended purpose.
